Everybody's case is different, when it comes to how they feel being a in a foreign country and hanging by a thread to get a stable status and stable life. You seem to have gotten a stable job which probably means you are better than most of the people who are working as contractors. But what matters is being on Visa, are you able to enjoy your life here? Will getting a GC help you have a better life or will you continue to lead the same life?
I think if you believe getting a GC will help you lead a better life you should stay here - since your i140 is cleared its another 4-5 yrs wait max. On the other hand if your job here is unstable and you think you will have a better life back home, then you should move. Bangalore is a great city as long as you have a comfortable job and good pay.

Also I am trying to start my own IT training firm there so with gods on my side in 4-5 years that company can grow to a mid size firm.

I am VoIP Engineer I use to work in a branch office in different state from where I filed my labor. My company forced me to move to head office which in different state even though I explained them my situation they just refuse to listen. I moved to different state as I had no option. Now my labor is in jepordy. More over I was reluctant to move out of the state where I was before due to my personal choice so I posted my resume on monster expressing my job location in the state where I was working. I was overwhelmed to receive the response from top notch telecom companies and went through series of interviews. All the companies I interviewed with were ready to hire me with higher salary than my current company even the cost of living is lower in the state. The biggest obstacle came when they learned that I dont have GC and they asked me to contact as soon as I have one.
I am frustrated as hell feel like lets go back to India or other country but then when I look to other folks with GC and their lifestyle I think may be it is worth to taste the bitter moment today for sweeter tomorrow but question is how long ?:(
All I wanted to express we are not cheap labor as many anti-immigrant groups claim. Like me I know most of us have skills that are in high demand which will benefit many American Corporates and in turn will benefit America. Retrogression Backlogs and unnecessary formalities is creating a "loose loose" situation.

That is interesting. The steps that we followed were the ones told to us by the DC embassy. I think the only difference between your case and my wifes case is that her passport had just her First Name under "Given Name" and her "Surname" was blank. I think in your case you have the First Name and Last Name combined under the "Given Name" and "Surname" is blank.
I just spoke to Indian consulate, NYC. The procedure to correct the last name is very simple. All you need is an Affidavit from the person (Signed in US, saying that you are correcting your name.), 4 photos and a copy of 797 or Visa. No need of advertizements, or Indian affidavit.
Please note, this is applicable only if,
In your passport Surname is Blank

and you want it to be corrected to

They will issue a new booklet with corrected name. It's same day service in NYC.

next, I am in a similar 'somewhat out of status' position myself. i am filing for i-140/i485
I have been with the same employer since Jan 2004, and have every pay stub since then. However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.
For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.
Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007
I am filing a self-sponsored I140. So, my question is:
1) Should I wait for 2008/whenever to file my i485 and hopefully show one year w2 and try to see if that goes through?
2) Try to convince my employer to pay me the back wages for 2006 (they may agree) in lieu of some future pay cut or paid out vacation or trade my stock options. File an amended return with a new 2006 W2 (what are the risks of an audit??)
3) Try to wait till 2008, stamp my visa extension and then file for i-485 showing only 2007 w2.

According to a specialist on immigration forums "Mr UnitedNations" the unused visas are directly being used for EB3 ROW , I am not how he knows that but maybe thats what is happening.
Maybe EB3 ROW being a diverse group is being given more precendence than highly subscribed countries.

I have been in this country for 7 years and waiting for PD to apply for 485. I want to share with everybody how employers can really **** the GC. My labor was cleared in sept. 2004, that time it was current and was eligible for concurrent filing. My employer kept on delaying and applied during december christmas week end. Later he surprises me saying that it was rejected, attorney had sent 140 and 485 to California processing center instead of sending it to vermont. On the labor approval, it is clearly written that it should be sent to Vermont for 485. He did not provide me any proof that he had applied for 485 before retrogession was effective.
My spouse is equally qualified as I am and she is house wife from past 3 years. She thought of persuing masters, but we have to pay the fees of international students. The fees for residents is different than the fees for international students. We are not considered as residents though we pay our taxes here. The total fees to complete masters will not be less
than $22K.
I am also a slave like many. I would have had my EAD by Jan. 2005, my spouse would be working if she had EAD. At times it really frustrates me when I think about it. May be going back is a good option instead of getting ripped off from these *** employers and waiting for GC indefinitely. I cannot change my employer as I completed my 6 years unless there is a pre approved labor.

I had to be persistent with my complaint with the Ombudsman. Finally I got it later in the year. When I sent my complaint in, sometime in July 08, I thought I was among the few who were left out. But this thread suggests that there are a lot who were bypassed when they gave GC's to PD's in 2005 and 2006 last year.
