Recently, one of my co-worker who was on L1A, requested an extension of his Visa. His employer filed for an L1B instead and did not inform him until after filing it. Now USCIS has sent an RFE. Does anyone know if this can be grounds for rejection of his Visa? Is the employer legally correct in filing a changed Visa category at will without informing the holder? His wife is unable to obtain a driver's license since the Visa approval is pending. Does anyone know if this can be addressed? If so, how?

I was in the same situation like you are now and I wrote a detailed letter with all paper work, 2 color photographs and also the FP notice and explained the situation. I was lucky to see a LUD the day they received the paper work and in 2 days mine was approved and its on its way now.
Hope this helps. I understand this might not be the case for all but it worked for me.

We still in negotiation. not come to a stage where EAD has been asked for. i am wondering what else could they ask for other than EAD like do they need to provide any proof that they will sponsor my green card or do i need to file AC21 in advance.
to. lady gaga hairstylesI have a big problem that I got approved on the H1 Recapture to get back into US on January 15, 09 though my attorney screwed up by putting someone else background into the Petition Letter submitted to USCIS with my application. The petition letter to USCIS is all wrong. It states the wrong education, work experience and job duty. They put somebody else background into mine. They put the correct sponsoring company on the first page of the letter though at the end of the second page they put the wrong sponsoring company. In this case, what should I do and what should I answer at the US Consular in Malaysia to get my H1 Visa? What should I do now? Please advise. Do I have to resubmit the application back to USCIS? Will I get rejected? Please help. Thank you very much.

Currently, adjustment applications are granted employment authorization documents with only a one year maximum validity. Beginning later this month, we'll start issuing these documents with a two-year validity period for aliens who are waiting adjustment of status if their application is expected to be pending for more than a year.
This, again, is eliminating a persistent source of frustration for workers who are here, who have a pending adjustment application but have to go and renew their employment documents every single year. It's going to cut the paperwork there.

My I-485 application was filed under EB3 category when I was working for my previous employer (PD - October 2006). I changed my job in August 2008, but never sent any documentation for AC21. I now have close to 8 years of experience and also a masters degree (MBA) from a reputed univeristy here in the US.
Now that EB2 dates are so close to October 2006, is there anyway I can port my application from EB3 to EB2? I can initiate this discussion with my current employer and may be able to convince them to help me. But I want to know exactly what needs to be done.

Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.

Once I get the I-140, can I directly apply for the transfer and get the new H1 for 3 years instead of extending the current one first?
I am suggesting we should write to White House and to the Ben Bernanke in Mass and draw their attention towards a million people waiting for their green cards, logically they should have already got it(10 years waiting is illogical) but if USCIS use Visa recapture these people can get green cards and green cards to these people means a million new house buyers in the market new cars buyers etc etc. Everybody is going to get green card one day, why not now..That will help bail out the housing market. I'm sure it'll strike a cord with the lawmakers as it will benefit them politically....
